If you read this decision it refers to the entire Gies property as being within the one zone flood. Also the flood elevations are mentioned and also the potential changes to the regional flood if grade alterations along this section of Downey Rd. The flood elevations are very close to the proposed Downey Rd. elevation under the Hanlon.
Here is the July 2000 decision:
"The Hanlon Watershed and thus the Gies property is totally within a one zone floodway. While the GRCA discourages the development of roads or driveways through the floodplain, there are circumstances where they are allowed and can be considered and designed for passive use so not to affect flooding and the management of the floodplains. There are, however, certain guidelines with the Provincial Policy Statement – 1997 which must be met. (Ex. 3-C: Tab 2-a) Section 3.1.3. permits development and site alteration if:
"(a) the hazards can be safely addressed, and the development and site alteration is carried out in accordance
with established standards and procedures;
(b) new hazards are not created and existing hazards are not aggravated;
(c) no adverse environmental impacts will result; [3]
(d) vehicles and people have a way of safely entering and exiting the area during times of flooding, erosion and
other emergencies;"
The Gies application did not demonstrate that these guidelines could be met and as a result, the GRCA found the application to have an unacceptable risk to life and property in the event of a Regional Storm event. "
The entire document should be read for the info it contains information on the Kortright/Downey/Hanlon intersection and floodline elevations. I have also attached an aerial picture of this area.
The Gies property is directly across from the Y. Al Hearne was involved in this development application and can tell you more about where Gies planned to construct the proposed access roads.
Could you please have the city engineers look over this document and compare the info contained in the document to the proposed flyover at Downey Rd. and the Hanlon and also the alignment of the proposed southbound access ramp? There should be a estimation by an engineer of how the proposed grade changes and construction of the ramps etc. will impact the flow, velocity and direction of the 5, 25, 50, 100 year and regional flood through this whole area both east and west of the Hanlon.
At the Hanlon EA PIC # 2 we spoke to a representative of the MTO and expressed our concerns that there were no floodlines on any of the MTO mapping of this interchange.
This area of the Hanlon is considered to be part of a flood spillway for the entire Hanlon Watershed East of the Hanlon Expressway. Since the GRCA Hanlon Creek Flood Risk mapping was completed in the 1980's there has been a significant amount of impervious surface created through development such as the residential subdivision north of Edinburgh and the Hanlon Creek Business Park to name but a few. The creation of so much impervious may increase flood volumes. That is why I am urging the city to consider if there will be increased flooding problems associated with the alteration of the flood zone in this area.
The safety and emergency access of the residents of Kortright Hills could be at stake.
We are seriously concerned about this could you please look into this matter and get back to me before the council meeting on the Jan. 14 ? I am also forwarding this e mail to our council members and the Mayor for their information.
We will also be contacting the GRCA re this matter.
